Quit claim deed signed by Conrad Rutter’s heirs confirming Conrad Rutter Jr. as the sole owner of the western section of the Rutter farm in Leacock Township, dated April 5, 1762.

THIS INDENTURE, MADE The fifth day of April in the year of our Lord One Thousand Seven Hundred and Sixty-two.  BETWEEN Joseph Rutter and Barbara his Wife, Peter Rutter and Elizabeth his Wife, and William Gibbon and Elizabeth his Wife, all of Lancaster  County (the said Joseph and Peter being Sons and the said Elizabeth being the Daughter of Conrad Rutter, late of Leacock Township in the said County deceased) and Peter Rutter, Joseph Rutter and Andrew Rutter all of Cecil County in the Province of Maryland, Yeomen, and James Biles of the same Place and Rebecca his wife, (the said last named Peter, Joseph and Andrew being the Sons, and the said Rebecca being the Daughter of Andrew Rutter, deceased, who was another son of the said Decedent, Conrad Rutter) of the One Part  AND Conrad Rutter of the County aforesaid, Yeoman, another of the Sons of the said Conrad Rutter, deceased, of the other Part. 

WHEREAS in pursuance of a WARRANT from the Honourable the Proprietaries of the Province of Pennsylvania, dated the third Day of January one Thousand Seven Hundred and Thirty-three there was surveyed unto the said Conrad Rutter since deceased A CERTAIN TRACT OF LAND situate in Lancaster County, BEGINNING at a post a Corner of Land now of Nathaniel Lightner, thence by the said Land and Land of Daniel Watson, S:30° E. 319 Ps. To a Black Oak, thence by Land of William White N. 75° E. One Hundred and Twenty Perches to a black Oak, thence by Land of John Rouse S. 88° E. 118 perches to a Hickery marked for a Corner, thence by Land of the said John Rouse, Henry Skyles, and the Heirs of Peter Skyles N. 18° E. 280 perches to a Black Oak, thence by Land of the Heirs of Peter Skyles aforesaid N. 9° W. 107 perches to a Black Oak, thence by Land of Anthony Ellmaker S. 76° W. 330 perches to the BEGINNING.  CONTAINING Five Hundred and Eighty-eight Acres and the Allowance of Six Acres P. Cent for Roads, as by the same WARRANT and Survey remaining in the Surveyor Generals Office appears.

AND WHEREAS upon a settlement and Division of the Real and Personal Estate by and amongst the Children Legatees and Representatives of the said Conrad Rutter deceased to the Satisfaction of all concerned and interested therein, Two Hundred and Eight Acres of the said Tract of Land herein after described is allotted to Conrad Rutter the Sone of the said Conrad Rutter deceased for his Part and Share of his said Father’s Estate.

NOW THIS INDENTURE WITNESSETH, That all the said Parties hereto of the first Part for and in Consideration of their having received their several and respective Parts, Purparties and Shares of the Real and Personal Estate of the said Conrad Rutter deceased, and for and in Consideration of the Sum of Five Shillings a piece to them severally and respectively in Hand paid by the said Conrad Rutter, Party hereto of the second part (the Receipt whereof they do hereby severally and respectively acknowledge and confess) HAVE and every of them HATH granted bargained sold aliened released quit claimed and confirmed, and by these presents DO and every of them DOTH grant bargain sell alien release quit claim and confirm unto the said Conrad Rutter the Party hereto of the second part, his Heirs and Assigns,  ALL THAT Piece or Parcel of Land, Part of the said Five Hundred and Fifty [Eighty?] Eight Acres Tract, hereinafter described as follows, viz:  BEGINNING at a post a corner of Nathaniel Lightner’s Land thence S. 3 [S:30°?] E. 319 Perches to a Black Oak, thence by Land of William White N. 75 E. 44 perches to a Black Oak thence N. 10° E. 155 Perches to a post, thence East thirty one perches to a post, thence N. 58 E. 15 Perches to a post, thence East 17 Perches to a post thence N. 8° W. 58 Perches to a post, thence North forty four degrees East forty three perches to a post, thence North ninety five perches to a post, thence by Land of Steuart Herbert S. 76° W. 170 perches to the Place of BEGINNING.  CONTAINING Two Hundred and Eight Acres and One Quarter Acre of Land and Allowance aforesaid for Roads, TOGETHER with all Improvements, Rights, Members and Appurtenances thereto belong and the Reversions and Remainders thereof. 

TO HAVE AND TO HOLD the said hereby granted and released Land and Premises with the appurtenances unto the said Conrad Rutter, Party hereto of the Second Part, his Heirs and Assigns forever.  UNDER a proportionable Part of the Purchase Moneys Interest and Quit Rent due and to become due to the Honourable the Proprietaries of the said Province their Heirs and Successors.  AND the said Parties hereto of the first Part do for themselves and their Heirs severally and respectively, and not one for another covenant promise and grant to and with the said Conrad Rutter, party hereto of the Second Part, his Heirs and Assigns that they the said parties hereto of the First Part, the said hereby granted Land and Premises with the Appurtenances unto him the said Conrad Rutter, Party hereto of the Second Part his Heirs and Assigns, against them the said Parties hereto of the First Part, their Heirs and Assigns, severally and respectively and all other Person and Persons claiming or to claim by from or under them or any of them severally and respectively shall and will WARRANT and forever DEFEND by these Presents.

IN WITNESS THEREOF the Parties aforesaid to these presents have interchangeably set their Hands and Seals the Day and Year first above written.

YORK COUNTY SS: Before me the Subscriber one of the Justices and President of the County Court of Common Pleas in and for the said County of York, personally came Jacob Youner and being duly qualified on his Solemn Affirmation according to Law did declare and say that he was present and did see the within named Joseph Rutter and Barbara his Wife, Peter Rutter and Elizabeth his Wife, Willm. Gibson and Elizabeth his Wife, Peter Rider, Joseph Rider, Andrew Rider and James Boyl sign seal & as their Act and Deed deliver the within Instrument of Writing as and for the Use and Purpose therein mentioned and that he subscribed his Name as a Witness to the same, and also that he did see Emanuel Carpenter subscribe his Name as a Witness to the same and at the same time.  IN WITNESS WHEREOF I have hereunto set my Hand and Seal the 8th of Sept. 1787.  Heny.
